TENANCY AGREEMENT

GENERAL RENTAL CONDITIONS
1. Tenant will transfer the down payment, 50% of the rent, within 7 days after completing the booking process.
2. The tenancy agreement will be dissolved if tenant hasn’t transferred the down payment within 7 days after completing the booking process.
3. Tenant must have paid the total payment, at least one month before arrival date, or if agreed with landlord on other payment conditions.
4. Deposit is a fixed amount of 350 € or equivalent in USD or NAF (payed in cash at arrival).
5. Cleaning fee is 185 €.
6. The total rent amount includes normal use of water and electricity (1cub water per person per week water and 10kwh electricity per room per night). The air-conditioning in the bedrooms are working between 6pm and 10am, there is no air-conditioning in the living room, as the house has an open design to have an airflow through the house. On arrival day we will take the meter reading at begin for water & electricity. The renter agrees to the extra charge of water and electricity when exceeding the normal use. Prices are 0,25 € per kWh for extra electricity and 12 € per cub. for extra water (or equivalent in USD or NAF).
7. Possible complaints with regard to the rented object must be reported to the manager and/or landlord at the start of the rental period in order to enable the manager/landlord to solve things. The tenant is obligated to take all necessary, required steps to reduce the damage as much as possible; there are no refunds on complaints that can be solved during the tenants stay.
8. The landlord is not liable for theft, damage, injury and/or accidents with regard to goods or persons, caused during or as a result of the stay in the rented accommodation, if it is due to his/her intention or negligence.
9. If tenant leaves the accommodation he/she must close windows, doors gates carefully.
10. The landlord is not liable for lack of service from 3th party corporation as, Internet provider, power/water/gas supplier.
Rights and duties landlord
1. The landlord shall deliver the rented object to the tenant at the agreed time, clean and in a good condition.
2. The rented object is completely furnished and upholstered. Bed linen, towels and beach towels available.
3. Landlord has taken out a solid fire insurance with regard to the rented object with inventory.
Rights and duties tenant
1. The house is only intended for holiday accommodation, to be used by the amount of persons written in invoice.
2. Tenant is not allowed to cause inconvenience (noise pollution) to other inhabitants in the surrounding area.
3. Tenant declares to be familiar with location, design and good condition of the rented object.
4. Tenant is not allowed to rent the rented object to third parties, or to exceed the max. number of persons, the villa is booked for, without prior written permission of the landlord.
5. Tenant commits himself/herself to use and maintain the accommodation as a good tenant. He/she is responsible for damage to the rented object, inclusive of damage or loss of (a part of) the inventory, caused during the rental period, unless the tenant can prove that the damage can’t be ascribed to him/her, his/her family members or guests. The amount paid out by the insurance is deducted from the damage.
6. The rented object must be left in a good and tidy condition, after the rental period.
7. Smoking is not allowed in the villa.
8. Pets are not allowed in the villa.
9. Diving equipment (especially tanks) are not allowed on terrace or in the pool
10. Tenant will use the rented object as holiday accommodation only and will not practice a profession.
Cancellation
1. In case of cancellation by tenant, until 30 days before arrival date the cancellation costs are 50% of the total rent.
2. In case of cancellation until 7 days before arrival date the cancellation costs are 100% of the total rent.
3. Landlord is always in right to cancel the reservation/ booking at any given time before or after arrival of tenant.
4. If landlord makes cancellation after tenant has made a payment, landlord have to return immediately all the payments back to tenant what tenant has paid to landlord.
